1. General

1.1. These Terms and Conditions apply to all purchases made through Ernel Design, including all products available via our website at ydu.com.au. By placing an order, you agree to be bound by these terms.

1.2. Ernel Design reserves the right to amend, modify, or update these Terms and Conditions at any time without prior notice. It is your responsibility to review these Terms regularly to stay informed of any changes.

2. Orders

2.1. All orders placed through our website constitute an offer to purchase. An order is not accepted, and a contract is not formed, until you receive a separate email from Ernel Design confirming that your order has been shipped.

2.2. We reserve the right to limit the quantities of products purchased per person, per household, or per order.

3. Pricing and Payment

3.1. All prices are listed in Australian Dollars (AUD) and include applicable GST (Goods and Services Tax), unless otherwise stated.

3.2. Payment for goods and services is due at the time of order placement. Accepted payment methods include credit cards, debit cards, and other online payment options.

3.3. Ernel Design strives to ensure that all prices on our website are accurate, but errors may occur. In the event of an error, we will notify you and allow you the option to proceed with the corrected price or cancel your order.

4. Shipping and Delivery

4.1. We offer various shipping options, and the estimated delivery time will be provided at checkout. Delivery times are estimates and are not guaranteed.

4.2. Shipping costs are calculated based on the delivery address and selected shipping method. These charges will be displayed at checkout.

4.3. Ernel Design is not responsible for delays or damage caused by third-party couriers or postal services. The risk of loss or damage to the product passes to the customer upon delivery of the product to the customer’s nominated delivery address.

5. Warranty

5.1. All products sold by Ernel Design are covered by the manufacturer’s warranty, subject to the terms and conditions set forth by the manufacturer.

5.2. To the maximum extent permitted by the Australian Consumer Law, Ernel Design excludes liability for any consequential or indirect loss, including but not limited to loss of wages, time, or profit.

5.3. Warranty claims must be submitted in accordance with the manufacturer’s warranty process. Customers are encouraged to contact us for assistance with the warranty claim process.

5.4. To make a warranty claim, the customer must provide proof of purchase and, where applicable, documentation regarding the defect.

5.5. If the manufacturer determines that the product is defective, Ernel Design will, at its discretion, either replace the item or refund the purchase price.

6. Returns and Exchanges

6.1. Where a product failure is not a major failure, Ernel Design reserves the right to choose between providing a repair, replacement, or refund. Where a product failure is a major failure within the warranty period, the customer is entitled to choose a replacement or refund.

6.2. If the product is not defective and you simply change your mind, we do not accept returns or exchanges unless specifically stated at the time of purchase.

6.3. To return an item, you must contact us within 14 days from the date of delivery. The product must be returned in its original condition, unused, and in the original packaging.

6.4. Customers are responsible for any return shipping costs.

7. Consumer Rights

7.1. Our Terms and Conditions are in accordance with Australian Consumer Law. This means that nothing in these terms excludes, restricts, or modifies your rights under Australian law, including your rights to a repair, replacement, or refund in certain circumstances.

7.2. If a product is found to be defective under the manufacturer’s warranty, your rights as a consumer are not affected by these terms.

8. Limitation of Liability

8.1. To the fullest extent permitted by law, Ernel Design is not liable for any loss, damage, or injury caused by the use or inability to use the products purchased through our website.

8.2. Ernel Design is not liable for any consequential, incidental, special, or indirect damages arising from the use of its products, including but not limited to loss of profits, loss of time, or any other financial loss.

9. Intellectual Property

9.1. The website, its content (including all text, graphics, logos, images, product photos, audio/video clips, digital downloads, and data compilations), and the trademarks, names, and designs associated with “Ernel Design” and its products, are owned or licensed by Ernel Design and are protected by Australian and international intellectual property laws, including copyright and trademark laws.

9.2. You acknowledge and agree that you obtain no interest or rights in the intellectual property of Ernel Design other than for the purpose of personal use of the website and products.

9.3. You must not modify, copy, reproduce, republish, upload, post, transmit, or distribute any material or content from the Ernel Design website in any way without the prior written permission of Ernel Design.
